For the last few months I have been smoking jerky and pulled pork, I have been making some $ along the way... About 100-150$ a month. It's not a lot but I love doing it .
I want to start making beef sticks and selling beef jerky and beef sticks at flea markets
I don't want to get in trouble;
My question is: do I need a licance

Do I have to claim on taxes?
 
Yep, what Craig said.  The Health Department will also require that you use a "commercial kitchen" so to speak.  They will come out and do an inspection of your equipment and certify it or tell you what needs to happen for it to be certified.
