WOW, I feel your pain man.

Customer Service has left the planet!!
I have seen some of the worst treatment to myself and to others in the past couple years it is frightening to say the least!!!

Sam's completely screwed me out of $450.00 when someone hacked my sam's Ccard and I called Customer Service to get advice and a stoppage of payment. They told me it was all being handled and there was NOTHING I needed to do they would take care of it... the charge NEVER left my card and I refused to pay. To this day they claim they never talked to me over the phone about it!!! ARE YOU KIDDING ME!!! WTF happened to "This call may be monitored and recorded for quality assurance purposes"
????

I'll bet if I would have SLANDERED someone over the phone they'd reproduce that call in a New York Minute!!!

Maybe if you just went back to the store and told them to either take the POS back or met you in small claims court, they will be a little more understanding.
You might also remind them that most judges could care less what their store policies are as store or company policy has nothing at all to do with law.

You cant threatin to sue a major corp like sams they would laugh in my face, but i will drive by and throw the damn thing through the window of the store

Wow,, we actually try to buy big purchases there because they have always taken things back with no questions. I even started buying winches for my company there cause they took destroyed one back, no questions asked.

I would go in and ask to speak to the manager and just tell him you are not satisfied with the product and want to return it. I think they give you 1 year to return items.

well ive tried that route and i wasn't a dick to the guy on the phone today but that's next, you know the funny thing is the peice of crap burned up the fuse on the first slice i used it for so i put in the replacement fuse and same thing so i was like there's no way im mailing this thing back so i wrapped the fuse in foil and it worked good for a while, F chefs choice too

I agree but the problem is i don't even have a decent receipt to use as i bought it online and i printed up the order page they told me to and they still couldn't take it back at the store because they don't sell the pos anymore so its not in their system

Start working the chain of command. If the counter person is b.s.ing you, find out who is his/her boss. Repeat, if that doesn't work, find out who their boss is. If the local store won't handle the problem, get a hold of the district manager. There's always somebody in charge. Take it on up the food chain. Get names, numbers, position title, of all the people involved all the way. You'd be surprised how nervous some people get when you ask for name, rank, position and your phone number. Document, document, document. How much is the resolution worth to you? You'll need that information if you decide to go see Judge Judy anyway. Sugar or Honey works much better. Pitching the item back at them will just get you in trouble with the cops. They may be sympathetic to your reason for causing damage, but.... the law is there for them as well as you. The store will write you off as a crank and you lose, no matter how right you are.

You can always sit out on the public street near the store with big signs calling attention to your problem. Might generate some interest news wise, maybe even a tv interview if it's really slow newswise.

You don't really sue them. You just have them summond to small claims. Likely they will just give you what you wnat to keep from pissing away the time in court. They either have to show up or you win a judgement by default. To them it;s not worth the time either way so they will just do what they were supposed to do all along.

While this is true, you would definitely want to check out the laws in your state about this. I know that in some states, companies are not required to have any sort of return policy, nor even have it available in writing!

It's shady for a company to do that (and that's why most don't), but they REALLY can make up their own rules as they go in some states (I'm pretty sure NC is this way, and I know MO, KS are).

Suing is a good threat to make, as well, just be prepared to not get ANY help from the time that you say the words "Lawyer" or "Sue" in a lot of places. I know that in my company, if someone threatens those things, I'm supposed to inform them that I can no longer discuss the matter, as I am not a lawyer. Then I have to get off the phone, or ask them to leave until the matter is resolved.

I would check your laws to if I remember right most state do NOT make them or any company have a return policy...It is up to the store whether or not they will...that being said I would go talk to the store then the district manager and let them know politely that you would like you membership cancelled and that you will let everyone you know about this situation....and then start sending emails out to management, I bet within 2 weeks problem resolved....just my .02

Small claims does not require the involment of a lawyer. It's typically a very small and very local affair. All you're tying to do it get them to pay attention and take care of you. They will usually do that to save themselves the aggrivation.
One thing is for sure though. As soon as you sit down and give up and deem everything impossible, then you have lost for sure. In that case you may as well make your peace with it and get on with your life. Whining about something just wastes everyone's time, mostly your own.
