Advice dealing with Allstate Hail Damage

This has been going on for months now. They only covered half the roof and it is all damaged. I dont get replies to emails or phone calls. I have contacted anyone I been able to find. The only option I seeing right now is to file a complaint with the Texas Department of Insurance but not sure what that will do for me. Here are the pictures of damage to roof and shed that where not covered:

I know @SmokinAl had a claim and repairs from hail damage... Don't know what insurance company he has though... Maybe he'll chime in with some advice...
 
Is your agent local? Go to his office and tell him that you aren't leaving until it's resolved, or at least in motion. Had to do it with State Farm on an auto claim once. They are paid to take the lumps for you. I was polite and pleasant and didn't even have to fuss, just explained to him that the people bots on the the other end of the line weren't getting stuff done. I spent maybe 30 minutes in there and had a check show up 2-3 days later.

Been doing emails with him but he wont answer anymore. Was planning on going to his office tomorrow. I been with him 35 years.
 
If he doesn't take action an appointment with Insurance Commissioner may change their mind
 
@BrianGSDTexoma remind your agent how long you have been with them and that you have paid millions more in premiums than the roofs cost.
 
Brian did they give you the "Pro Rated" crap. I've heard often times they will say well your roof is XX number of years old so we gave you X percent of the total claim amount
 
You're all going to blast me, but I think you were lucky to get 50% on the shingles. I have seen worse.
Problem is their are few roofers (not shingle nailers) that know how to repair hail damage. Hot asphalt and rock granules and it looks as new.

Vinyl siding should be an automatic 100% replacement
 
I have had Allstate for years and had a claim in 2013 when a random delivery truck slammed into my garage and caused a lot of damage. Luckily I had video evidence with a primitive video surveillance system. I have since upgraded to 4K cameras around the house.

When it happened I sent them the video and the guys came to my door to admit what happened. Allstate worked well with me and using their suggested company to fix it I had to do nothing on my end. My garage was packed into a large container in the driveway while they did their work.

The only problem was a nosy neighbor complained about permits and that delayed it for a week.

That was a long time ago but thought it was worth sharing.

 
Morning Brian,
We had about $35,000 in damage to our house. Roof, siding, windows gazebo, carport, lanai, & patio aluminum roofs, also all gutters & downspouts. We had replacement coverage NOT depreciation coverage. You should check & see which you have. The folks here without replacement got very little $. Our neighbor had about the same damage as us, but his insurance only covered about $10,000 because he didn’t have replacement coverage. It took over a year to get everything replaced but my total outlay was the original $1000 deductible, and I basically have a new house. Our hail was baseball sized. Here is a photo of our bedroom window.

For us the best method to get action was email to the adjuster assigned to our case, not our insurance agent. We were assigned a claims person who I dealt with at least weekly for over a year until everything was settled. Also a lot of folks here who were having trouble with their ins. Company, hired a private adjuster. They cost a couple of hundred, but they get-er-done! And the insurance company usually accepts their estimate. Good luck brother, I know the stress your going thru. I was a full blown alcoholic until this was finally over. Ha, now hurricane season is upon us!

You should check & see which you have
I do have replacement. I will get some more money when work is completed. The claim got sent to another adjuster as the first one got promoted during the claim. The second rarely answers emails or phone calls. He also lies when he does answer. I gave him page numbers from photo's to look at and said he looked at google earth and looked OK. When finally made him look at photo's while on phone he said they where not there before. Even asked me to give him a 9 or 10 on survey. I at the end of my rope! I getting very stressed now and can't let it go. Trying to get them to send an adjuster out but they won't.
 
Brian, If you have replacement ins., then they have no choice but to do the repairs. I used my own contractor for the main house roof & they gave me a bunch of crap & had to wait on the money. So for the rest of the repairs I used their contractors, and would not sign off until all the work was done to MY satisfaction. The contractors don’t get paid from the ins. Co. Until you sign a paper that the job was done to your satisfaction. As long as you are not putting money up front, just sit back & wait. THEY HAVE TO FIX YOUR DAMAGE. If you would feel better, there are lawyers who specialize in this, and would work on a contingency basis. If they won’t send out another adjuster I would hire an independent one. Bottom line is EVENTUALLY your house will be repaired. I can tell you are just like me, and I know how much this bothers you. Were there a lot of homes in your area with significant damage? In my community of 1200 homes, EVERYONE received some damage, many were worse than ours. It has been well over a year since the storm of (9 minutes) did all this, and we still have many homes & businesses that have not been repaired yet. The only last piece of advice I can give is to watch out for scammers, they chase these storms around the country & get a down payment & never do the work. Good luck!

I just talked to another roofer who happened to be somebody I used to work with. He just did another house a couple houses down for me with the help of a public appraiser. Ended up costing the insurance a lot more than what they would have had to pay. He got them to pay for a new decking also. There is hope!

If it's $20k or less worth of value you can send a demand letter including your supporting evidence, supported claims of no response, and a reasonable deadline for them to reach a reasonable conclusion or else you will take actions they are financially responsible for. Actions like get it fixed out of pocket and they reimburse you.

Formal demand letters and small claims court works well for other things like this and does not need a lawyer.

Now if you have access to a non-blood sucking scumbag piece of trash lawyer that won't bleed you dry (big "if"), getting a lawyer involved with the insurance company will make them jump fast as hell.
It is more costly for Allstate to litigate an issue and then to potentially have to pay out on top of it, than it is to just pay and do the damn job they should be doing.
This is a double edge sword. It will also be costly for you to involve a lawyer as well, hence me opening with a demand letter and small claims court.

This sucks man but hopefully you can get it done for the least amount of pain possible.

yep just starting this too, upstairs leaked wiped out downstairs bathroom and part of the kitchen.
