Walmart+ and Walmart Problems

I was so surprised to learn my Lowe's account would deliver so many things. They will deliver or ship a $7.99 single item. And we're are in a Rural AG district.

Before this last storm, I was shocked to see the couple bags of salt I wanted had a deliver for free choice. I'll be danged if they didn't. Problem was, one of the bags had hardened like concrete. The person that picked it, and the driver never stopped and thought that was unusual, apparently...didn't care more likely. I ordered a replacement and some gloves, then unlike the first order, it never got scheduled for days. I was getting concerned because the storm was coming the next day.

So I called, and shockingly got customer service. Dude told me an Uber driver had not scheduled the pickup and delivery. Yes...Uber. Lowes uses Uber! If I were an Uber driver and accidentally got that salt delivery job, I would never want to deliver for Lowes again! So I brought my solid block of salt back, and returned it and picked up my other order while I was there. Could have saved the entire hassle if I had just not bitten on the "free delivery".

I will order some merchandise to be shipped and delivered, but never food, especially fresh food and NEVER restaurant or fast food. Even when I pick cooked food up myself I take care to open certain containers (fries, wings, ect.) as soon as it's in the car, otherwise that stuff will be limp or soggy by the time I get it home. They put stuff like fries and wings in Styrofoam or plastic containers with lids and it ruins the texture or crispiness. Delivery drivers cant do that because it's clear tampering with the containers.

A last relative note. We have a big steel arbor over our sidewalk entrance. I custom made it for my wife back when I was a fabricator. A FedEx truck, in a God-awful hurry backed right in to it. Had my home-office window not been right above the location, they would have driven off and not reported it. But they were stunned to hear, then see me at the open window looking right over them.

They gave me their bosses info, called him and let me talk to him. Turns out, THEY were private contractors! Yep, an official FedEx truck, run by "ABC contracting". They paid to have the arbor straightened and re-powdercoated. They DID NOT want me reporting the collision to the actual FedEx. They didn't even file insurance, they didn't want it known it happened at all and paid me directly with a check.

So yea, it's like that.
 
That sucks. In the end Walmart should be responsible for it.
 
I just had an issue with Amazon. They also use private delivery contractors quite often, now.
I ordered a 2 lb. bag of Mexican hot chocolate powder, as it was on a good sale. (I love this stuff.) It arrived promptly, and the box was pristine. But when I opened it up, the bag (which was loosely enclosed in another plastic bag) was compromised, and there was loose powder all over.
I asked to get a replacement, but all they were willing to do was refund my money. Well, at least I got that. By and large, Amazon's return policy isn't bad.
 
Don't take this the wrong way but Wallyworld is a place you visit,it's not a place that should ever visit you.
If I wasn't disabled with mobility issues I would probably go there but hate having to depend on my wife to go all the time
I throw the BS card on Walmart. "They" hired a contractor, "they" control the contractors actions, "they" are responsible.

The principle of “respondeat superior” comes into play here. This legal doctrine holds an employer accountable for the actions of an employee, but typically not for an independent contractor. The key lies in the degree of control the employer has over the individual performing the work.

If the employer dictates how, when, and where the work is to be completed, the worker is likely an employee. In contrast, independent contractors usually have more freedom to decide how they complete their tasks.

Vicarious liability, often referred to as imputed liability, is a fundamental legal principle particularly relevant in the realm of employment. This concept holds that an employer can be responsible for the actions or failures of its employees when these occur as part of their job duties. Rooted in the notion that an employer should bear the risks associated with the activities from which it benefits, vicarious liability is a form of strict, no-fault liability, meaning the employer’s responsibility is established irrespective of personal fault or negligence.

Central to the application of vicarious liability is the concept of the “scope of employment.” For an employer to be held liable, the employee’s actions must be closely related to their job responsibilities. For example, if a delivery driver has an accident while performing deliveries, the employer may face liability as the driver was engaging in their work.

Walmart establishes the delivery window before the purchase is completed. Therefore they control the actual delivery. The Delivery Driver was clearly engaged in a "scope of his employment" when he/she ran over your Starlink dish.

In my opinion, Walmart is stuck with the cost of this. They may recover from their contractor, but I think the level of control they exercised about when and where the package would be delivered, even the option of how (leave directions option at time of purchase, ie, leave at garage, put on porch, etc...), makes them liable for the acts of their contractor.

By strange coincidence, I had someone hack my Walmart account this morning. They tried to get a curbside delivery in Denver. Wally wasn't much help, only confirmed that I'd been hacked. Had to delete my account with them, and I'm not sure I want to set up another one.

I won't have an account after all this crap is over.
I'm still waiting for a call back from the guy who sent the email glad I'm not holding my breath till I get it
So I called the toll free customer service number and talked to someone I had a hard time understanding but bottom line was nothing they can do but they are going to escalate the claim and someone is going to call me back yeah again won't hold my breath. I called the phone number they provided for the insurance company of the driver of course it wasn't the right number. Finally got a good number called and of course nobody had contacted them about it. Gave the info over the phone and they said an adjuster would contact me. Got a call this morning from adjuster and as soon as she read the details she says "Am I right that this occurred while they were delivering a Walmart order to your house?" told her yes at which time she said I had to talk to a different adjuster and gave me a number. Called that number and of course got a voicemail and she didn't contact me back yet. Yeah I know it's Friday. I expect them to tell me that the guy doesn't have insurance to make commercial deliveries and they won't cover it but we'll see.
Yeah idiot drives where he has no business driving and runs over the satellite and I have to spend all kinds of time trying to get it covered by somebody. Probably be better off just to spend the about 500 bucks for a new system but it's the principle.

So, it appeared that they got into my account, changed the password and CC# (probably bogus). But they couldn't change the email, so I kept getting notices that my order was ready to pick up. "Mohamed", yeah that was his name, assured me that the order had been canceled. But later, I got a confirmation that the order had been picked up. Wally's going to be eating that one.
 
Home Depot does the same thing. Outside contractors to deliver items. Ordered a snow blower and asked them to take the pallet with them and as I was putting it on their truck the guy threw it in the street and threw me down and assaulted me. I'm 70 years old.Called the police and made a report. Called corporate and the guy told me they are independant contractors and told me to deal with them. Very rude guy. Never shopped at Home Depot again
 
When you talk to Corporate after the "escalation", tell them just send you a new dish or you are calling your lawyer to let them handle it. They sell the dang things so their loss will be minimal. Starlink Dish - Walmart.com
 
That sucks, @pineywoods and wish that hadn't happened to you. The same is true for Amazon, unfortunately. The companies that don't use their own drivers and outsource that service rid themselves of that liability and it sucks. Glad you have Spectrum to keep ya connected.
 
I got an email yesterday asking for a review of "my" Walmart purchase.
I went over the story again, how it was a fraud purchase on my account, but they used a different credit card, and how someone else picked it up several states over, and how that order was supposed to be canceled, but somehow wasn't.
Today, I got this:

"Dear Michael,

Thank you for your feedback about your recent online order. I sincerely appreciate your feedback and I am very sorry the items you needed were not 100% in quality, color, dates and condition and in your case, your card has been hacked and someone picked up your order. This is very disappointing to hear as we teach and train every associate to ask for the correct information when at the car. Again, I truly am sorry that we were so careless with your order and will do better in the future.

Do you need a refund? If so, please contact 1-800-Walmart and/or you can use the Walmart app. The reason I say that is because we do not have access to your credit card information here in OGP and they will need to speak with you directly. We want you to have a positive experience every single time no matter who is dispensing your order. I am sorry we fell short and will continue to make changes here forward."


It's obviously a case of "the right hand doesn't know what the left is doing". Just ticks me off that the fraudsters got away with it, due to Walmart incompetence.
 
If they used another card, but used your Walmart account to make the order, I would bet the other card is stolen as well. Walmart should be able to reset you email associated with the account to the old and you should be able to reset the password, etc... then. If they don't fix it I suspect the next thing is someone reports the fraudulent card usage and it takes the police to your account. Keep all those emails, etc... as you may have to prove your innocence (yeah, I know it's not supposed to work this way, but in the real world it often does). Even if the police don't come after you the card issuer may turn it over to a collection agency, etec....

I would also suggest reporting this to your local police/sheriff. That way you have an official report your account was hacked and used by unknown persons for fraud on file should anyone every come after you for the fraud. They should be able to take it over the phone in most agencies.

I figured all that was just too much trouble, so I just had them cancel my account altogether. I've only ever bought 2 things from them online, anyway.

It's only getting worse. There are rarely customer service humans that are English as a first language. I politely tell them I cant understand them, therefore they cannot help me and hang up.

Re-reading this made me curious. You said the driver ran over your Starlink. Was it just laying on the ground? I've never had one.

Honestly, thats what I'm looking forward to with AI. It will probably improve customer service eventually. At least its fairly coherent and I can understand it. The downside is we will never be able to believe what we see on screens anymore. I saw some cinematic examples the other day that were incredible deep fakes. Hopefully someone comes up with a way to watermark or authenticate real video.

The Star Link Satellite that I had came with a short tripod that had places for stakes/pins and on that was about one foot pipe that the dish clicked into. All together I would guess it sat probably a little over 2' high. But did you read the part about the moron drove at least 75 yards through the grass to drive over it. Nobody should be driving where this idiot did.

So today a adjuster called me back after giving him the basics again and telling him yes I had pictures and a Walmart Claim Number. He says will you please text or email me all that information. He says that the driver drives for Spark they deliver for the Walmart's and that Spark self insurers their drivers. Then he proceeds to say guess who owns Spark that's right Walmart does. He said he went ahead and filed a claim with Spark but cautioned it will take Spark a bit to actually pay up.
The guy that sent the email from Walmart Claims Services still has not called me back.
So basically all this amounts to is Walmart trying to screw people. It's a shame they have run all the mom and pop and local grocery stores out of business.
