Refurbished parts sold as new - Char Griller direct - normal?

Recently decided to buy four new grates for the main section of my Char Griller charcoal grill / smoker.  They were purchased from Char Griller's site directly, and I even ended up calling them to place the order due to a malfunction on their website.

The package arrived within the timeframe specified, but when I opened it, the four grates were a little grimy looking, some had spots where you could visibly see rust, and others had areas where it was obvious a dremel (or something similar) had been used to file off bad areas.

They also included a three-pronged fork (which sold for $1.95 from their site), which I didn't order, and a pamphlet about Jesus (seriously).

Is this the norm?  I called and got a generic voicemail message.  Haven't been able to speak to a live person yet.

Just frustrated that the supposedly new grates are used, and not in any shape to be used without some additional work (which is what I was trying to avoid by buying NEW)...
